Notice is hereby given of a Public Participation Process (PPP) in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998, as amended), the Environmental Impact Assessment (EIA) Regulations, 2014 (GNR982 of 2014, as amended), National Environmental Management: Air Quality Act, 2004 (Act 39 of 2004, as amended) and the National Water Act, 1998 (Act No. 36 of 1998, as amended), for an Environmental Authorisation (EA) Application, Atmospheric Emission Licence (AEL) Application, and Water Use License Transfer of Ownership to be submitted to the Competent Authority.
BACKGROUND
Jinxuan Business (Pty) is proposing to construct and operate a brick manufacturing plant near Pretoria in the Gauteng Province. The proposed facility will comprise a rotary kiln, stockpiles (coal, clay, final product), and a souring plant. The proposed project will require an EA and AEL. The center coordinates for the site are 25°40’08.6″S 28°26’06.3″E.
LEGISLATIVE PROCESS
The proposed project will trigger activities published under the Environmental Impact Assessment (EIA) Regulations, 2014 (GNR982 of 2014, as amended) and Listing Notices as well as the List of Activities which result in Atmospheric Emissions (GNR 893 of 2013, as amended). The following activities will be triggered:
EIA Regulations, 2014 and the Listing Notices
Listing Notice 1 (GNR 983 of 2014, as amended)
- Activity 27: The clearance of an area of 1 hectares or more, but less than 20 hectares of indigenous vegetation.
Listing Notice 2 (GNR 984 of 2014, as amended)
- Activity 6: The development of facilities or infrastructure for any process or activity which requires a permit or licence or an amended permit or licence in terms of national or provincial legislation governing the generation or release of emissions, pollution or effluent.
Listing Notice 3 (GNR985 of 2014, as amended)
- Activity 12: The clearance of an area of 300m² or more of indigenous vegetation except where such clearance of indigenous vegetation is required for maintenance purposes undertaken in accordance with a maintenance management plan.
Gauteng:
- Within any critically endangered or endangered ecosystem listed in terms of section 52 of the NEMBA or prior to the publication of such a list, within an area that has been identified as critically endangered in the National Spatial Biodiversity Assessment 2004;
- Within CBAs or ESAs identified in the Gauteng Conservation Plan or bioregional plans; or
- On land, where, at the time of the coming into effect of this Notice or thereafter such land was zoned open space, conservation or had an equivalent zoning.
List of Activities which result in Atmospheric Emissions (GNR 893 of 2013, as amended)
Category 5: Mineral Processing, Storage and Handling
- Subcategory 5.9: Ceramic Production
- Description: The production of tiles, bricks, refractory bricks, stoneware or porcelain ware by firing, excluding clamp kilns.
- Application: All installations producing 100 ton per annum or more.
PUBLIC PARTICIPATION PROCESS
The purpose of the Public Participation Process (PPP) is to notify Interested and Affected Parties (I&APs) of the proposed project and to provide them with the opportunity to raise issues or concerns regarding the project.
As part of the PPP, the identified I&APs, stakeholders and the public are provided with a 30-day period from 21 August 2026 until 22 September 2026 to register as an I&AP and participate in the PPP.
